O R D E R

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.22 of 2025, on the file of the Central Crime Branch, Salem City Police.

2. The case of the prosecution is that the accused induced the de facto complainant to invest Rs.60,95,000/- in a real estate project and cheated the de facto complainant. During the course of investigation, it came to light that the petitioners have signed the documents on behalf of the other accused. Based on the complaint given by the second respondent/de facto complainant, the first respondent police registered the case in Crime No.22 of 2025, for the offences under Sections 120B, 418 and 420 of IPC on 03.09.2025, which is now sought to be quashed. 2/6

Learned counsel appearing for the petitioners would submit that there is no mention about the petitioner's name in the FIR and the petitioners had been falsely roped in this case. Hence, he prayed to quash the First Information Report pending against the petitioners. 4.

Per contra, the learned Government Advocate (Criminal Side) would submit that the petitioners, along with other accused, have induced the de facto complainant to invest Rs.60,95,000/- in a real-estate project, in which they do not have any right and cheated the de facto complainant. He would submit that though the petitioner's name do not find place in the FIR, during the course of investigation, it came to light that the petitioners have also signed in several documents to assist the other accused in the offence. He would submit that apart from the de facto complainant, the petitioners have also cheated several other victims and total amount cheated is Rs.5.66 crores. He would further submit that the case has been registered only on 03.09.2025, and the respondent have to collect further documents and the investigation is at a very nascent stage. Hence, he objected to quash the case against the petitioner. 3/6

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that the case was registered only on 03.09.2025 and that the investigation is at a preliminary stage, this Court is not inclined to interfere with the investigation and does not find any merit in this petition to quash the First Information Report.
