This writ petition has been filed for issuance of a Writ of Mandamus, directing the 1st respondent to consider the petitioner's representation dated 30.06.2021 and to pay difference in retirement benefits.
2. The case of the petitioner in brief:
The petitioner was appointed as Security Guard in the respondents Transport Corporation and he retired from service on 31.01.2015. According to the petitioner, as per the Settlement No.C1/066920/2014 dated 13.04.2015, his pay has to be revised with basic scale of Rs.13,800 + Grade pay Rs.2,450/-. But the respondents, has not paid the salary, as per the settlement with the revised scale of pay. Though the writ petitioner filed writ petitions in W.P.No.20105 of 2016 and W.P.No.26950 of 2019 and got directions against the respondents to consider his representations, the respondents have not complied with the orders passed by this Court. The petitioner has also made several representations, but the respondents have not considered it. Hence this writ petition.
3. The learned Standing Counsel appearing for the respondents 2/5
submitted that, the representation of the petitioner will be considered by the authorities concerned and appropriate orders will be passed, in accordance with law, within a time frame as fixed by this court.
4. Inview of the above submissions and also considering the limited scope of prayer, without expressing any opinion on merits, this court is inclined to pass orders.
5. Accordingly, it is ordered as follows:
i) The respondents/Corporation are hereby directed to consider the petitioner's representation dated 30.06.2021, as expeditiously as possible, and pass orders on its own merits, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
