ORDER

(Order of the Court was made by S.M.Subramaniam J.) The present intra court appeal has been instituted challenging the writ order dated 02.09.2024 in W.P.No.17235 of 2010.

2. The writ petitioner is the appellant before this Court. Writ proceedings was instituted challenging the letter issued by State Industries Promotion Corporation of Tamil Nadu Limited dated 08.08.2006.

3. Perusal of the letter reveals that the appellant submitted an application seeking NOC and transfer of lease hold rights in the name of M/s. Meenakshi Exports (Vellore) Private Limited. On examination, the respondents declined to grant NOC on the ground that the appellant has to remit a sum of Rs.28.43 lakhs towards the differential land cost.

4. Such a letter of intimation issued by the respondent would not provide any cause for institution of writ proceedings. The contractual obligations between the parties are to be determined by way of an adjudication based on the documents and evidences and the terms and conditions agreed between the parties. Such an endeavour cannot be undertaken by the writ Court in exercise of the powers of judicial review under Article 226 of the constitution of India.

5. Thus, the writ petition per se is not entertainable since the issues are relating to contractual obligations between the parties. Thus the writ Court rightly rejected the writ petition and consequently, the writ appeal stands dismissed. There shall be no order as to costs.
