.. Respondent Prayer: Writ Petition under Article 226 of the Constitution of India praying to issue a writ of mandamus, directing the respondent to dispose of the petitioners representation dated 13.12.2013 by completing the enquiry within the time limit, that may be fixed by this Court.

ORDER

Heard.

2.This writ petition has been filed praying that this Court may be pleased to issue a WRIT OF MANDAMUS, directing the respondent to dispose of the representation of the petitioners, dated 13.12.2013, by completing the enquiry within the time limit, that may be fixed by this Court.

3. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the respondent had submitted that the petitioners ought to have made their representation to the Tahsildar concerned, with regard to the issuance of pattas, in respect of the property in question, and not the District Revenue Officer. He had further submitted that the petitioners may be directed to submit a fresh representation https://hcservices.ecourts.gov.in/hcservices/

to the Tahsildar concerned within a time frame, and on such representation being made, the Tahsildar concerned may be directed by this Court, to pass appropriate orders thereon.

4. In view of the said submission made by the learned counsel appearing on behalf of the respondent, the petitioners are permitted to make a fresh representation, with regard to the issuance of pattas, in respect of the land in question, to the Tahsildar concerned, within a period of four weeks from the date of receipt of a copy of this order, along with a copy of this order.

On such representation being received from the petitioners, the Tahsildar concerned, shall consider and dispose of the same, on merits and in accordance with law, after giving an opportunity of hearing to the petitioners. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.

5. In such circumstances, this writ petition stands ordered with the above observation. No costs.
