PRAYER : Criminal Original Petition filed under Section 439(1)(b) of Code of Criminal Procedure, to modify the condition imposed by the learned Vacation Sessions Judge, Namakkal made in C.M.P.No.490 of 2015 dated 27.05.2015.

O R D E R

Petition for modification of the bail condition imposed by the learned Vacation Sessions Judge, Namakkal in C.M.P.No.490 of 2015 dated 27.05.2015.

2. The learned Vacation Sessions Judge, Namakkal, granted bail to the petitioners directing them to deposit a sum of Rs.5,000/- each before the learned Judicial Magistrate, Paramathi. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioners submitted that in view of the onerous condition, the petitioners were not able to come out on bail. He further submitted that in respect of other accused petition filed before this Court and no condition was imposed against them to deposit and thus, he prays to modify the condition imposed by the learned Vacation Sessions Judge, Namakkal.

4. In the circumstances, the order of the learned Vacation Sessions Judge, Namakkal, passed in C.M.P.No.490 of 2015 dated 27.05.2015 is modified to the effect that the condition imposed on the petitioners to deposit a sum of Rs.5,000/- each before the learned Judicial Magistrate, Paramathi, is hereby deleted. Except this modification, other conditions remain unaltered.

5. This Criminal Original Petition is disposed of accordingly.
