PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents 1 to 3 to take appropriate disciplinary action against the 5th respondent consequently suspend him from the service till the disposal of the Criminal Case in Crime No.246 of 2012 on the file of the 4th respondent. ORDER

This Writ Petition earlier came up for consideration on 14.08.2025. As there was no representation for the petitioner, the matter was directed to be listed under the caption ''for dismissal'' today. Today, in spite of the matter being listed under the caption ''for dismissal'', there is no representation for the petitioner.

2. However, learned Additional Government Pleader, appearing for respondents 1 to 4, brought to the notice of this Court that the relief sought for in the writ petition has become infructuous, in view of the fact that the Crime No.246 of 2012, registered against respondent No.5 herein, was already

quashed by this Court in Criminal O.P.Nos.14573 of 2017, 17112 of 2015 and 24197 of 2015 and the appeals filed thereagainst by the petitioner herein vide Criminal Appeal Nos.10 to 12 of 2023 (SLP {Crl.} Nos.5746 to 5748 of 2018) before the Supreme Court of India have been settled between the petitioner and the fifth respondent, by virtue of an order, dated, 14.12.2022. A copy of the said order, dated 14.12.2022, is also placed before this Court.

3. In the light of the above, this Writ Petition is dismissed, for having become infructuous. No costs. Consequently, the connected M.P.Nos.1 and 2 of 2013 are closed.
