ORDER

(Order of the Court was made by R.Subramanian J.) The petitioner, who was appointed in the year 2017 has been denied an opportunity to seek promotion as Assistant Engineer because of the proceedings of the Chairman and Managing Director dated 19.02.2018. The said proceedings itself says that the service regulations must be amended accordingly. It is therefore, clear that on the date, when the petitioner served as Assistant, the rules that were existing enable the petitioner to have an avenue for promotion as an Assistant Engineer by way of an internal selection.

2. It is claimed by the appellant that the amendment as contemplated by the Managing Director in his letter dated 19.02.2018 have not been carried out. Even assuming that the amendment has been carried out, it can only have a prospective effect. Hence, there will be a direction to the respondent to keep one post in the cadre of Assistant Engineer (Electrical) till disposal of the writ appeal.
