ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 4 (1) (aaa) , 4 (1-A) of the Tamil Nadu Prohibition Act, in Crime No.283 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. According to the prosecution, 110 litres of Pondy arrack packets was entrusted by this petitioner to one Arun and the said Arun was intercepted on 19.02.2022 near Kothandapuram market. From the confession statement by the said Arun, the fact that the contraband was entrusted by this petitioner and the said contraband was transported in TVS Jupiter bearing Regn. No. TN82-W-3520 owned by the petitioner herein hence, this petitioner is arrayed as A2.

The learned counsel for the petitioner has submitted that A1 has already been arrested and released on bail and so far as the vehicle in which the contraband alleged to have been transported has already been sold to the said kumar A1 and for which the delivery note dated 17.03.2021 have been relied and produced. https://hcservices.ecourts.gov.in/hcservices/

The learned Government Advocate has opposed that the delivery note is a local document and this petitioner has two previous cases and the confession statement of the co-accused is relevant for the purpose of investigation which clearly inculcates the petitioner herein as a person who organised the transport of ID arrack into state of Tamilnadu and sold it for premium sent.

5. This Court finds that abscondance of this accused will perpetuate the crime and for completion of investigation, his arrest is needed.
