The petitioner/A5 in Crime No.566 of 2023 registered by the respondent police for the offences punishable under Section 8(c), r/w 20(b)(ii)(A) of NDPS Act 1985 r/w 328 of IPC with respect to an occurrence which took place on 25.12.2023 seeks anticipatory bail.

2. It is stated that A1 to A5 were found in possession of 100gms of ganja. The petitioner had run away from the place. A1to A4 had been arrested and granted bail.

3. The learned Government Advocate (Crl.Side) raised strong objections for granting of any relief by pointing out the previous antecedents of the petitioner wherein the petitioner has been involved in 11 previous cases including two under NDPS Act. Both those cases had been registered in the year 2023.

4. Taking that fact into consideration, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. Vv 28.02.2024 2/3
