2. PW-2[Senthil Kumar] one of the victim is the revision petitioner. The date of judgment is 22.11.2005. Since at that point of time there was no law empowering the victim or person interested in the victim to prefer the appeal against the order of acquittal, the present revision case is filed before this Court invoking Sections 397 r/w 401 of the Criminal Procedure Code.
3. The case of the prosecution centered around the act committed by the first respondent herein and others, who are his henchmen. It is brought to the notice of this Court by the learned counsel appearing for the revision petitioner that the first respondent has met the maker.
4. From perusal of the impugned order of acquittal passed by the trial Court and the grounds of the revision, which mainly centers around the deceased first respondent, this Court is of the opinion that it will be a futile exercise to go in detail about the merit and demerit of the order passed by the trial Court. Hence, this Criminal Revision Case is liable to be dismissed.
5. Accordingly, this Criminal Revision Case is dismissed. Sd/- Assistant Registrar(CS VIII) //True Copy// Sub Assistant Registrar ari To 1.The District Munsif cum Judicial Magistrate, Vaniambadi.
