..Respondent Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to consider the petitioner's representations dated 02.05.2018 and 29.11.2019 based on the G.O.Ms.No.237, Finance [pay Cell] Department dated 22.07.2013 and G.O.Ms.No.303, Finance [Pay Cell] Department dated 11.10.2017 to rectify the pay anomaly within a reasonable time as may be fixed by this Court.

O R D E R

This writ petition has been filed for the issue of writ of Mandamus directing the respondent to consider the representation made by the petitioner, who is seeking for rectification of a pay anomaly, based on certain Government Orders.

The case of the petitioner is that he was appointed as a Junior Engineer in the respondent transport Corporation in the year 1986. Thereafter, he was promoted as an Assistant Engineer in the year 1996 and further promoted as a Senior Engineer in the year 2000. The petitioner is working in this position till date. According to the petitioner, there is a pay anomaly on the ground that some of his juniors are getting a higher basic salary than the petitioner. According to the petitioner, there are Government Orders, which covering the said issue and the same gives the guidelines for removal of the pay anomaly. The petitioner had given representations in this regard to the https://hcservices.ecourts.gov.in/hcservices/

respondent on 02.05.2018 and 29.11.2019. Since there was no response, the present writ petition has been filed before this Court.

Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent. 3.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the respondent to consider the representations made by the petitioner on 02.05.2018 and 29.11.2019, on its own merits and in accordance with law, and pass appropriate orders, within a period of six weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the respondent along with copy of earlier representations dated 02.05.2018 and 29.11.2019 and also a copy of this order. 4.

This writ petition is disposed of with the above directions. No costs.
