O.A.Nos.101 to 103 of 2023 KRISHNAN RAMASAMY.J., When the matter came up for hearing on 27.03.2023, this Court passed the following orders:

"Service of notice to the first respondent has been completed. However, none appeared on behalf of the first respondent.

2. Mr.B.Gautham, learned counsel undertakes to file Vakalat on behalf of the second respondent and seeks time to file the counter affidavit.

3. Registry is directed to print the name of the first respondent in the cause list and list the matter on 17.04.2023 for filing the counter affidavit.

4. The interim injunction already granted by this Court vide its order dated 15.02.2023, is extended till then."

2.Though notice served on the 1st respondent and the name of the 1st respondent is printed in the causelist, none appeared on behalf of the 1st 1/4

respondent, which shows that the 1st respondent is not interested to contest the case.

3.Learned counsel appearing for the 2nd respondent would submit that the 2nd respondent is only a formal party.

4.Learned counsel appearing for the applicant would submit that they are under the process of initiating the arbitration proceedings and therefore, he seeks leave of this Court to approach the learned Arbitrator and to extend the interim order already granted by this Court vide order dated 15.02.2023. 5.Considering the submissions made by the learned counsel appearing for the applicant and the 2nd respondent, the interim order already granted by this Court is made absolute and the petitioner is permitted to approach the learned Arbitrator within a period of three months from today. Further, in the event, the parties are intent to vacate the interim order granted by this Court, they shall file appropriate application before the learned Arbitrator to get necessary orders.

6.With the above directions, no further order is required and hence, this Court feels it appropriate to close all these applications. 7.Accordingly, these Applications stand closed. 17.04.2023 rst 3/4
