ORDER

This Criminal Original Petition has been filed for a direction to the learned Special Court for POCSO Act cases, Chennai to expedite the trial in Spl.S.C.No.26 of 2018 and complete the same within a stipulated time.

Heard the submissions of learned counsel appearing for the petitioner.

Taking into consideration the facts and circumstances of the case, there shall be a direction to the learned Special Court for POCSO Act cases, Chennai to expedite the hearing in Spl.S.C.No.26 of 2018 and complete the same, within a period of two months from the date of receipt of a copy of this order. It is brought to the notice of this Court that the accused person did not appear before the Court below during https://hcservices.ecourts.gov.in/hcservices/

the hearing date and hence, a non-bailable warrant has been issued against him and the same is pending execution. The 1st respondent is directed to immediately execute the non bailable warrant and produce the accused person before the Court below.If there are no sufficient reasons for the accused person for not appearing before the Court below and he is intending to drag on the proceedings, the Court below shall follow the guidelines issued by the Hon'ble Supreme Court in STATE OF UTTAR PRADESH VS. SHAMBHU NATH SINGH (JT 2001 (4) SC 3191).

4. This Criminal Original Petition is disposed of with the above directions.
