PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the condition imposed by the this Court in Crl.O.P.No.2125 of 2025 in para 4 that "accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties (out of which, one of the sureties should be the blood related surety of the petitioner) each for a like sum to the satisfaction of the learned IX Metropolitan Magistrate Court, Saidapet, Chennai, dated on 29.01.2025 pending before this Court. ORDER

The petitioner seeks modification of the condition that directs the petitioner to produce one surety who is a blood relative imposed by this Court in para no. 4 in Crl.O.P.No. 2125 of 2025 dated 29.01.2025.

2. The learned counsel for the petitioner submitted that though the order was passed on 29.01.2025, the petitioner is unable to execute the sureties, and still he is languishing in jail because he does not have a blood relative to be offered as surety.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the final report has also been filed.

4. This Court is of the view that considering the fact that the final report has been filed and the fact that the petitioner is still languishing in jail in spite of the bail order, the said condition can be modified as follows: "4. Having heard the ............accordingly, the petitioner Page No.2 of 4

is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties (both sureties should be local residents) each for a like sum to the satisfaction of the IX Metropolitan Magistrate Court, Saidapet, Chennai, and on further condition that:

5. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.

6. Accordingly, the criminal miscellaneous petition is ordered, and the condition is modified.
