ORDER

This writ petition has been filed for direction directing the respondent to consider the petitioner's representation dated 16.01.2012 and to reinstate him in service as Driver.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent and perused the materials available on record.

3. The petitioner was appointed as a Driver in the respondent Corporation. Initially, he was under training and after the training period, he was posted at Udumalaipettai division. During his probation, he caused accident and as such he suffered charges for the offences under Sections 279 and 304A of IPC in Crime No.1257 of 2011. Therefore, the license of the petitioner was seized by the Investigation Agency. Hence, he was not allowed to work further, since he was under probation.

4. Now, the petitioner submitted a representation to reinstate him into service. When the petitioner caused accident, he was under probation period, his service was not engaged by the respondent and as such, the petitioner is not entitled for any reinstatement to the post of Driver.

5. Therefore, this writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs. 23.08.2023 Internet : Yes Index : Yes/No Speaking order/Non-speaking order mn
