IN THE HIGH COURT OF JUDICATURE AT MADRAS

THE HONOURABLE MR. JUSTICE M.DHANDAPANI A.Saraswathy ... Petitioner vs.

... Respondent Prayer: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, seeking to punish the respondent for the disobedience of the order of this Court dated 04.07.2022 passed in W.P.No.11921 of 2022.
For Petitioner : M/s.S.Gowsik Sundar For Respondent : Mr.K.M.D.Muhilan Additional Government Pleader 1/4
ORDER
This Contempt Petition is filed seeking to punish the Respondent for wilful disobedience of the order dated 04.07.2022 passed by this Court in W.P.No.11921 of 2022.
2. Mr.K.M.D.Muhilan, learned Additional Government Pleader appearing for the respondent/contemnor submitted that the petitioner has filed a Writ Petition in W.P.No.11921 of 2022 seeking for Mandamus, to direct the respondent to consider the petitioner's representation and grant patta in his favour for an extent of 10.5 cents in Aiyur Agaram Village. Pursuant to the direction of this Court, patta was issued in favour of the petitioner and recording the same, this Court vide order dated 04.07.2022 closed the said writ petition. However, the grievance of the petitioner is that the patta was granted in his favour only for an extent of about 7 cents. Hence, the present Contempt Petition has been filed.
3. On a perusal of the records, it is seen that no positive direction was issued by this Court in favour of the petitioner and this Court had 2/4
simply recorded the submission of the learned Government Advocate and closed the said writ petition, as the petitioner's representation was already considered and patta was granted in favour of the petitioner. If at all the petitioner is aggrieved, he is at liberty to work out the remedy in the manner known to law before the Appellate Authority.
4. Accordingly, the Contempt Petition is closed. 17.03.2023 Index : Yes/No Speaking Order/Non-speaking order sp 3/4
