This petition has been filed to condone the delay of 344 days in filing the above Criminal Revision Case.
2. Mr.Leonad Arul Joseph Selvam, learned Government Advocate (Crl. Side) takes notice for the respondent police and he has not raised any objection to allow this petition, since the present petition has been filed only to condone the delay of 344 days in filing the above Criminal Revision Case, which against the order dated 18.01.2019 passed by the learned Judicial Magistrate No.1, Vellore, in Cr.M.P.No.129 of 2019.
3. Heard, the learned counsel appearing on either side.
4. In fact, through the impugned order dated 18.01.2019, the learned Judicial Magistrate No.1, Vellore, refused to entertain the protest petition filed by the revision Petitioner. Now on going through the impugned order passed
by the learned Judicial Magistrate, only by considering the delay, the said order has been passed.
5. Therefore, being satisfied with the reasons stated in the affidavit filed in support of the petition, this Criminal Miscellaneous Petition is allowed. 30.03.2022 Note: Registry is directed to number the Criminal Revision case, if it is otherwise in order.
