2.
Heard the learned counsel appearing on either side and perused the materials available on record.
3. Initially, based on the complaint lodged by the petitioner, the respondent registered an FIR in Crime No.361 of 2023 for the offences punishable under Sections 419, 420, 468, 470, 471, 472, 417, 463 and 464 of IPC and Sections 3(1)(f), 3(1)(g) and 4 of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities Amendment) Act, 2015. After completion of the investigation, the respondent closed the FIR as "Further Action Dropped". Pursuant to the filing of the closure report, the petitioner was served with a Referred Charge Sheet notice. Aggrieved by the same, the petitioner filed a protest petition, which was dismissed after a detailed enquiry.
4. A perusal of the closure report, as well as the order dated 12.06.2024 passed in Crl.M.P.No.2054 of 2024 by the Principal Sessions Judge, Krishnagiri, reveals that the entire allegations are civil in nature and no cognizable offence is made out warranting the filing of a final report. That apart, the petitioner failed to initiate appropriate civil proceedings against the counter parties.
