(The Order of the Court was made by The Hon'ble The Chief Justice) Learned Advocate General has produced in court a schedule for submission and disposal of applications to be issued by the Directorate of School Education for persons seeking exemption from taking examination in Tamil and the same reads as under: SL.No .

ITEM DATE & PERIOD 1.

Submission of Applications by Student to the Principal/Head Master on or before 20.07.2016 2.

Forwarding of application by the Principal/Head Master of the school to the competent authority.

Within two weeks from the receipt of application.

Considering and forwarding recommendation by the competent authority to the Director of School Education Within two weeks from the date of receipt of application by the competent authority.

4.

Forwarding of applications with recommendation from Director of School Education to the Government.

Within two weeks from the date of receipt of application by the Director of School Education.

5.

Considering and passing order by the government.

Within two weeks from the date of receipt of application.

If any student is on transfer from another State after 20.07.2016, as his/her parents in Government Service or in employment of Public Sector Undertakings/ Institutions/ Companies/ Corporations/ Private Employment/ Business in

other States, the application of such students may also be considered on merits provided the application is submitted prior to preparation of nominal roll for the X Standard Board Examination, 2017.''

We did put to the learned Advocate General whether it may be more advisable to have a committee rather than leave it to a single officer to decide this issue as the numbers may be large and then delay occurs, that being our experience for the last academic year 2015-2016, when we had expressed such an apprehension in December, 2015, but it was assured that those applications would be processed. What resulted was a mass rejection and therefore an omnibus order from us granting everybody exemption from the subject. The larger issue of ensuring that Tamil is learnt across the board is already subserved by the fact that possibly at best one percent students sought exemption. This would naturally decline in phases over a period of time. Our concern was that there are certain institutions which claim that Tamil teaching did not even commence on account of paucity of Tamil Teachers. An example of this is given by learned Senior Counsel canvassing the case in W.P.No.2540 of 2016 that in Kanyakumari, in a Government School, Malayalam was being taught and not Tamil.

4. Learned Advocate General however submits that as per a recent policy announced (copy not available as yet), such exemption would be only available to students who come on transfer to schools in Tamil Nadu. Thus, he states that no exemption for any institution is to be granted.

5. Naturally, learned counsel for the petitioner states that such a policy would have to be assailed by them in accordance with law.

6. In view of the aforesaid, the issue of appointment of a committee to look into each individual institution claiming exemption is at large, as the policy sought to be propounded would come in the way of the same. It is only in any proceedings assailing the policy, this question would arise.

7. At request of the learned counsel appearing for the Anglo-Indian Schools, we clarify that the aforesaid would equally apply to them.
