PRAYER: The Criminal Original Petition is filed under Section 528 B.N.S.S., 2023, to call for records in C.C.No.4630 of 2016 pending on the file of XX Metropolitan Magistrate, Egmore, at Allikulam and quash the same as against the petitioner.

ORDER

The present Criminal Original Petition has been filed to call for records in C.C.No.4630 of 2016 pending on the file of XX Metropolitan Magistrate, Egmore, at Allikulam and quash the same as against the petitioner.

2. In this case, the trial has already commenced in C.C.No.4630 of 2016 and the complainant has examined the witnesses P.W.1 to P.W.4. After commencement of the trial, there is no question of quashing the entire proceedings.

3. In view of the above, this Court is not inclined to quash the proceedings in C.C.No.4630 of 2016 on the file of the XX Metropolitan Magistrate, Egmore, at Allikulam. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
