DATED : 20.04.2018

CORAM

THE HON'BLE MR.JUSTICE S.M.SUBRAMANIAM W.P.No.4861 of 2014 and M.P.No.1 of 2014

1. N.Meeriam

1. The Chairman, Tamil Nadu Housing Board, No.493, Mount Road, Nandanam, Chennai - 600 035.

2. The Executive Engineer and Administrative Officer, Annanagar Division, Tamilnadu Housing Board, Chennai - 600 101.

... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Mandamus to direct the respondents to consider the petitioners' representation dated 30.11.2013 and pass orders within the time frame to be fixed by this Court.

For Petitioner : Mr.N.Suresh For Respondents : Mr.V.Anandhamoorthy

O R D E R

The relief sought for in the writ petition is for a direction to the respondents to consider the representation submitted by the writ petitioners dated 30.11.2013.

2. The said representation sought to be considered by the writ petitioners is enclosed in page number 25 of the typedset of papers filed along with the Writ Petition.

3. On a perusal of the entire contents, the writ petitioner claims that Plot No.6, Plot No.205, Kaviyarasu Kannadasan Nagar, Masuthi Street, Kodungaiyur, Chenna - 600 118, is to be registered in the name of the writ petitioner. The writ petitioner states that the title and ownership in respect of the https://hcservices.ecourts.gov.in/hcservices/

said plot is unknown and therefore, the said plot has to be registered in the name of the petitioner. The claim made in the representation is absolutely misconceived and the writ petition filed seeking a direction to consider such representation cannot be maintained at all. It is a pre-condition that the petitioners to establish their legal rights for the purpose of seeking a direction to consider the representation.

4. In the present case, the writ petitioners had sent a representation to the respondents seeking registration of sale deed in their favour in respect of the plot, wherein, the ownership is unknown. This being the factum, as expressed in the representation submitted by the writ petitioners, this Court is of the considered view that the writ petitioners have not established even a semblance of legal right.

5. Thus, the relief sought for in this writ petition is devoid of merits and accordingly, the writ petition stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
