The petitioner has filed this writ petition seeking issuance of Writ of Mandamus, directing the respondents to consider and pass orders on the petitioner's representation dated 12.01.2022 with regard to issue of patta to the petitioner within a stipulated time as fixed by this Court.
2. The case of the petitioner is that, the disputed properties are a ancestral properties. The petitioner and his brother acquired the properties by way of unregistered partition and thereafter, they constructed house and the petitioner was allotted ground floor in the said constructed house. Thereafter, the petitioner paid property tax, metro water tax and electricity service connection stands in his name and he also obtained Ration Card, Aadhar Card and Voter ID in his name, https://hcservices.ecourts.gov.in/hcservices/
based on which the petitioner made a representation dated 12.01.2022 for issuance of patta to the petitioner. However, till date no order has been passed. Hence, the present writ petition has been filed with the aforesaid prayer.
3. The learned counsel for the petitioner would submit that this Court may issue a direction to the 2nd respondent to consider the representation of the petitioner dated 12.01.2022 for issuance of patta to the petition, within a stipulated time as fixed by this Court.
4. In view of the aforesaid submissions, considering the limited relief sought for by the petitioner, this Court directs the 2nd respondent to consider the petitioner's representation dated 12.01.2022, after providing full opportunity of hearing to the petitioner and aggrieved parties, if any, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
