O R D E R

The petitioners, who were arrested and remanded to Judicial custody from on 26.07.2025 for the offences punishable under Sections 303(2) of BNS @ 303(2) and 111(2)(b) of BNS, in Crime No.777 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioners is that they were involved in the theft of a two-wheeler worth about Rs.1,00,000/-. It is the further case of the prosecution that the petitioners were arrested and the stolen property was recovered from them in accordance with law. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners were arrested on 26.07.2025 and have been in judicial custody for a considerable period. Though it is stated that they involved in previous cases, they have been in custody for nearly five months. Hence, he prays to grant bail to the petitioners.

4. The learned Government Advocate (Crl.side) appearing for the respondent submitted that the first petitioner is involved in nine previous cases, including three cases under NDPS Act and six other cases of similar nature. The second petitioner is also involved in six previous cases of similar nature. He further submitted that the petitioners are habitual offenders and the stolen two-wheeler has already been recovered from them. Hence, he opposed to grant of bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

Considering the fact that though the stolen two-wheeler has already been recovered from the petitioners and also taking into account their involvement in several previous cases of similar nature, this Court is of the view that the petitioners appears to be habitual offenders. Hence, this Court is not inclined to grant bail to the petitioners.
