O R D E R

This writ petition has been filed challenging the impugned proceedings of the first respondent dated 09.02.2023 and consequently, direct the respondents to return the land belonging to the petitioner in S.No.52 to an extent of 3.10.50 hectares, situated in K.Echampadi Village, Karimangalam Taluk, Dharmapuri District.

2. Heard Mr.J.Pradeep, learned counsel for the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing for respondents.

3. The case of the petitioner is that the subject property was 2/4

assigned by the Boodhan Board and petitioner was utilizing the property for agricultural purposes. In G.O.No.680, dated 17.10.2006, this land was allotted for construction of a Government Higher Secondary School. This land was not put to use and the school is functioning elsewhere. Therefore, the petitioner sought for the assignment of the land and handing over possession of the property to the petitioner. The same was rejected by the first respondent through proceedings dated 09.02.2023 and aggrieved by the same, the present writ petition has been filed before this Court.

4. In the considered view of this Court, the petitioner does not have any legal right to seek for the relief of reallotting the land in favour of the petitioner. The land admittedly does not belong to the petitioner and the respondents want to utilize the same for construction of a Government Higher Secondary School. Therefore, this Court does not find any illegality in the order passed by the first respondent dated 09.02.2023.
