Respondents Prayer:- Criminal Original Petition filed under Section 482 Cr.P.C., praying to direct the 1st respondent to register the complaint and offer police protection at the cost of the petitioner and also to evict all the trespassers including members of the second respondent Union from the petitioners factory premises at Sholinghur, Vellore District and allowed ingress and egress of men and material pursuant to the complaint of the petitioners dated 05.06.2015.

ORDER

This Criminal Original Petition has been filed praying to direct the 1st respondent to register the complaint and offer police protection at the cost of the petitioner and also to evict all the trespassers including members of the second respondent Union from the petitioners factory premises at Sholinghur, Vellore District and allowed ingress and egress of men and material pursuant to the complaint of the petitioners dated 05.06.2015. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents and perused the material placed on record.

3. The learned Additional Public Prosecutor submitted that based on the complaint lodged by the petitioner, the petition enquiry is pending in CSR.No.181 of 2015 before the first respondent.

4. Recording the submission of the learned Additional Public Prosecutor, the first respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1.

5. It is also represented that there is an industrial unrest in the factory of the petitioner and therefore, the first respondent police is also directed to afford police protection to maintain the Law and Order in and around the petitioner's Company for the purpose of preventing breach of peace. With the above directions, this Criminal Original Petition is closed.
