O R D E R

This petition has been filed to direct the respondents to register the case on the complaint of the petitioner dated 8.8.2014 and investigate the matter and to file a final report under Section 173(2) Cr.P.C.

Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing for the State. 3.

The learned Additional Public Prosecutor submitted that on the complaint dated 8.8.2014, petitioner enquiry was conducted in CSR 175 of 2014 and closed on 16.3.2014 on the ground that the petitioner did not co-operate for the conduct of enquiry. 4.

The learned counsel appearing for the petitioner submitted that the complaint lodged is against the husband, who is working in Police Department and hence the complaint of the petitioner has been closed perfunctorily.

Under such circumstances, the respondent Police is directed to once again conduct enquiry in CSR No.175 of 2014, and during the course of the enquiry, if any cognizable offence is made out, a regular case shall be registered, following the law laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar https://hcservices.ecourts.gov.in/hcservices/

Pradesh and Others reported in (2014) 2 SCC 1. The petitioner is directed to co-operate for the conduct of enquiry by the respondent Police.

The Criminal Original Petition is closed with the above directions.
