The writ miscellaneous petition is filed to modify the order, so as to direct the Assistant Commissioner of Labour, Coimbatore (Authority under Payment of Gratuity Act, 1972) to hear the Gratuity Case.

2. The petitioner has stated that the writ petition was filed in the year 2004 and during the relevant point of time, the first respondentAssistant Commissioner of Labour, Salem was the Competent Authority to deal with the cases under Payment of Gratuity Act, 1972. Subsequently, there was a change in the jurisdiction and now the case falls under the jurisdiction of the Assistant Commissioner of Labour, Coimbatore, who is the Authority under Payment of Gratuity Act, 1972.

3. It is contended that both the petitioner and the second respondent are residing in Tiruppur District and now the Tiruppur District is 1/3

falling within the jurisdiction of the Authority at Coimbatore.

4. This being the submissions made, the Gratuity Case is to be transferred by the first respondent to the Assistant Commissioner of Labour, Coimbatore for the purpose of disposal of the same by following the procedures as contemplated and by affording an opportunity to all the parties concerned.

5. Thus the said case is directed to be transferred by the first respondent to the Assistant Commissioner of Labour, Coimbatore (Authority under the Payment of Gratuity Act, 1972).

6. With the abovesaid directions, the writ miscellaneous petition stands allowed.
