C.M.P.No.5869 of 2023 in C.M.A.SR.No.20207 of 2023 N.MALA,J, This petition is filed to condone the delay of 385 days in preferring the above Civil Miscellaneous Appeal.

2. Mr.S.S.Santhosh Kumar, learned counsel, who takes notice on behalf of the respondent, fairly submits that he has no serious objection to the delay of 385 days being condoned, subject to the condition that the interest for the delay period of 385 days is forfeited.

3. In view of the above submissions, the delay of 385 days is condoned and the petition is accordingly ordered, on condition that the petitioner shall forfeit the interest for the delay period of 385 days.
