ORDER
The petitioners, against whom a case in Crime No.577 of 2025 on the file of T-3 Korattur police station has been registered for the offences under sections 406 and 420 of IPC, have filed this quash petition. 2.Case of the prosecution is that in the year 2023, the petitioners were introduced to the second respondent by his friend Manikandan. The petitioners have discussed with the second respondent about doing fire crackers business saying that the fire crackers business would earn good profits. Believing the words of petitioners, the second respondent has given money to the petitioners on various occasions and totally, the second respondent had given Rs.10,00,000/- to the petitioners and it was decided to share the profits equally.
But as agreed, the petitioners did not share the profits and also did not pay back the investment made by the second respondent. Hence, the second respondent has made a complaint before the respondent police which was registered in crime no.577 of 2025 and the investigation is going on. 3.This court heard the learned counsel for the petitioners and the learned Government Advocate (Criminal side). It is seen that by passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves. It is submitted that the first petitioner has settled the money to the second respondent. A memorandum of understanding has been arrived at between the first petitioner and the second respondent and the same has been annexed in the present petition. As per the memorandum of understanding, it was agreed not to proceed with the investigation. 4.Under such circumstances, no useful purpose will be served in keeping the case pending, even though, the offences involved are not compoundable in nature.
In the light of the guidelines given by the Hon'ble Supreme Court reported in (2017) 9 SCC 641-(Parbatbhai Aahir @ Parbatbhai Bhimsinhbhai Karmur Vs. State of Gujarat), and after exercising due caution as advised by the Hon'ble Supreme Court in State of Madhya Pradesh v. Dhruv Gurjar and Another reported in (2019) 5 SCC 570, this Court in exercise of its jurisdiction under Section 482 Cr.P.C.,/Section 528 of BNSS is inclined to quash the criminal case in Crime No.577 of 2025 under section 406 and 420 of IPC pending on the file of the first respondent police station. 5.
