Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 1st respondent to consider the representation made by the petitioner dated 4.5.2012 to include the name of the petitioner in the appropriate place in the seniority list of 1999 batch of Sub Inspector of Police based on the rank secured by the petitioner in the selection with consequential benefit of service seniority on par with 1st batch training candidates including promotion and other attendant benefits and arrears of salary within a stipulated time to be framed by this Court.

ORDER

The issue is relating to fixation of seniority in the matter of Sub-Inspector of Police recruited during the year 1997-1998.

2. A counter affdavit is filed in this regard. It is relevant to extract para 15 of the counter affidavit which is as follows:- "15. With reference to the averments made in Para 5 and 6 of the affidavit, it is submitted that the seniority restoration proposal for the petitioner and few others who were affected has been sent to the Government and the same is under consideration of the Government. Hence the contention that no action was taken on his representation is not correct. As this is a common issue involving large number of candidates, a detailed consolidated proposal has been sent to Government in this office letter No.284045/Rect.II(1)/ https://hcservices.ecourts.gov.in/hcservices/

2011, Dated 26.6.2013. The Government have to pass necessary orders after scrutiny and after following necessary administrative procedure."

3. In view of para 15 of the counter affidavit, the learned counsel for the petitioner has submitted that the Government could be directed to pass ordes in terms of para 15 of the counter affidavit, within a stipulated period.

4. Mr.V.Jayaprakash Narayanan, learned Special Government Pleader states that since the matter involves large number of employees and also a complicated one, longer time could be given as stated in para 15 of the counter affidavit.

5. In these circumstances, the Writ Petition is disposed of, directing the Government to pass orders as stated in para 15 of the counter affidavit, as extracted above, within a period of six months from the date of receipt of a copy of this order.
