The petitioners/A1 & A2 in Crime No.06/AC/2024/TVL for offence under Section 7(a) of Prevention of Corruption Act, 1988, have filed this petition seeking a direction to the respondent police to file a final report expeditiously.
2.The contention of the learned counsel for petitioners is that the de-facto complainant for the purpose of running a business, applied for power loom EB service connection through on-line on 11.03.2024 in his mother's name. It is alleged that the said application was rejected for the reason that the de-facto complainant neither visited the EB office nor met the petitioners herein for any clarification. But projected the case against the petitioners as though there was a demand of bribe. In this case, the amount was recovered from A3. On his statement, the petitioners also remanded in this case. The second petitioner will attain superannuation on 30.05.2030. Due to the above case, the petitioners were suspended from service and their career is getting affected. Hence, the present petition is filed. Page No.2 of 4
3.The learned Government Advocate (Crl. Side) submitted that in this case investigation completed, charge sheet made ready and awaiting sanction for prosecution. Once the sanction is obtained, charge sheet would be filed within a period of three months.
4.In view of the above submission, the respondent police is directed to file a final report, as the case may be, within a period of three months from the date of receipt of a copy of this order under due intimation to the de-facto complainant. This three months period is only an outer limit.
5. With the above direction, this Criminal Original Petition is disposed of.
