This petition has been filed to withdraw and transfer I.D.O.P No. 17 of 2023 pending on the file of Family Court, Dindigul to the Family court, Salem.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. It is seen from the records that the respondent filed I.D.O.P No. 17 of 2023, on the file of the Family Court, Dindigul, for restitution of conjugal rights. Now, the petitioner living with her three year old child. Further, the distance between Salem and Dindigul is nearly about 190 kilometers.

4. Considering the distance between the petitioner's house and the Court, and also the fact that the petitioner is living with her three year old child. Hence, this Court is inclined to transfer the I.D.O.P No. 17 of 2023 pending on the file of the Family Court, Dindigul to Family court, Salem.

5. Accordingly, the present Tr.C.M.P. is allowed and the I.D.O.P No. 17 of 2023 pending on the file of the Family Court, Dindigul, is withdrawn and transferred to the file of the Family court, Salem. Further, the Family Court, Dindigul, is directed to transfer the records in connection with I.D.O.P No. 17 of 2023, to the Family court, Salem, within a period of two weeks from the date of receipt of a copy of this order. Further both parties directed to appear before the Family Court, Salem, for mediation not less than five sittings. No costs.
