The prayer sought for herein is for a Writ of Mandamus directing the 1st Respondent to consider and pass orders on the Appeal dated 19.10.2022 submitted by the Petitioner under Patta Passbook Act seeking an order to cancel the Patta No.1732 issued in favour of the 3rd Respondent herein to the lands in survey Nos.148/3 and 148/4 of Gengasoodamani Village Chetpet Taluk

2. In respect of Patta No.1732 at Gengasoodamani Village, Chetpet Taluk, Tiruvannamalai District issued by the 2nd respondent in favour of the 3rd respondent, who purchased the property from the 4th respondent who is none other than the father of the petitioner, the petitioner has filed appeal under Section 12 of the Patta Passbook Act to the 1st respondent Revenue Divisional Officer on 19.10.2022. In order to consider the appeal and to decide the same on merits within a time frame by the 1st respondent the petitioner has preferred the present writ petition.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the official respondents. In view of the order that is going to be passed in this writ petition, notice to the private respondents is hereby dispensed with.

4. Learned Additional Government Pleader would submit that, the said appeal filed by the petitioner and pending before the 1st respondent would be taken up and decided within a time frame that may be stipulated by this Court.

5. Considering the aforesaid submission made by the learned Additional Government Pleader appearing for the official respondents, this Court directs the 1st respondent to consider the appeal filed by the petitioner dated 19.10.2022 and pass orders thereon on merits and in accordance with law of course after giving an opportunity of hearing to the petitioner as well as the private respondents herein within a period of six weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No costs.
