ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c), 20(b)ii(B), Narcotic Drugs and Psychotropic Substances Act 1985 and 120-B of IPC, in Crime No.2239 of 2020, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with other accused persons were found in illegal possession of 4 kgs of Ganja. Hence, the complaint was registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor submits that the petitioner along with other accused persons were found in illegal possession of 4 kgs of Ganja. He would further submit that earlier this Court had dismissed the anticipatory bail application in Crl.O.P.No.1509 of 2020 dated 03.02.2021. submit that the custodial interrogation of the petitioner is required. Hence, he vehemently opposed to grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and that the petitioner has involved in very serious offence and there is no change of circumstances in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
