..Respondent(s) PRAYER: This Civil Miscellaneous petition has been filed under Section 151 of Code of Civil Procedure praying to amend the prayer in C.M.P. No. 22589/2019 as to condone the delay of 213 days in representation of CMP.SR.No. 16625 and 16626/2019 instead of condone the delay of 213 days in representation of the above said Second Appeal.

ORDER

This petition has been filed to amend the prayer in C.M.P. No.22589 of 2019 as to condone the delay of 213 days in re-presentation of C.M.P. SR No.16625 and 16626 of 2019.

2. According to the petitioner, he is the appellant in the main Second Appeal and he, already filed a petition in C.M.P. No.22589 of 2019 to condone the delay of 213 days in re-presentation of the petitions in C.M.P. SR No.16625 and 16626 of 2019. However, in the above petition in C.M.P. No.22589 of 2019, in the prayer, it has been wrongly mentioned as to condone delay of 213 days in representing the second appeal. Therefore, the same may be corrected.

3. This Court heard and perused the records.

4. Considering the above said reasons stated in the affidavit and there is a typographical error and the said error has to be rectified. Accordingly, this Civil Miscellaneous Petition is allowed.

5. To carry out amendment, post the matter on 03.03.2026. The Registry is directed to list all the pending applications. 20-02-2026 Index: Yes/No Speaking/Non-speaking order MJS
