Prayer :- Criminal Original Petition filed under Section 439(1) (b) of Criminal Procedure Code, praying to pass an order granting relaxation of the conditions imposed in bail order in Crl.M.P.No.450/2020 dated 05.02.2020, on the file of the Principal District and Sessions Judge, Coimbatore, to enable the petitioner to take treatment for his injuries at Apollo Hospital, Madras or other Super Specialty Hospital. ORDER

The present petition is filed seeking relaxation of the condition imposed by the learned Principal District and Sessions Judge, Coimbatore, in Crl.M.P.No.450/2020 dated 05.02.2020, while granting bail to him.

2. The petitioner herein is arrayed as an accused in Crime No.9/2020 on the file of the respondent police, and faces accusation for the offences under Section 294(b), 353 and 506(i) IPC r/w.Sec.4 of TNPHW Act, 2002, and that he has been in judicial custody from 21.01.2020. The petitioner was granted bail by the Sessions Court in Crl.MP.No.450/2020 Vide order dated 05.02.2020, imposing certain conditions. The petitioner is now before this Court seeking relaxation of conditions imposed by the Sessions Court.

3. The learned Government Advocate (Criminal Side) submitted that the petitioner has been complying with the condition from 07.02.2020, whereas the petitioner complains of custodial torture during remand, and that he wanted to take treatment in https://hcservices.ecourts.gov.in/hcservices/

Chennai in terms of advice of the Orthopaedic Surgeon in Pollachi, that he needs to take certain treatment to rule out any nerve or vessel injury around his heels.

Considering the said submission, the condition imposed as against the petitioner by the learned Principal District and Sessions Judge, Coimbatore, in Crl.M.P.No.450/2020 dated 05.02.2020, is relaxed and the petitioner is directed to report before the respondent police as and when required for interrogation.
