This Petition filed seeking Letters of Administration with Will annexed with respect to the Will dated 22.08.1990 executed by C.P.Ramanathan, the uncle of the petitioner and the respondent herein. The respondent had given a consent affidavit. It is stated that Ramanathan had died on 21.06.1992.

2. It is also claimed that Ramanathan was staying with the petitioner and the petitioner was taking full care of his paternal uncle of Ramanathan. Since the respondent had given the consent affidavit, parties were directed to adduce evidence. The petitioner was examined as PW-1. The original Registered Will dated 22.08.1990 was marked as Ex.P-1, the death certificate of C.P.Ramanathan was marked as Ex.P-2 and the consent affidavit of the respondent was marked as Ex.P-5.

3. To further prove the Will, K.Munirathinam was examined as PW-2. He identified the Will and stated that he and Govindarajan had signed as attesting witness. He also filed affidavit, which was marked as Ex.P-8. He stated that C.P.Ramanathan was in a sound and disposing state of mind at the time of execution of the Will.

4. In view of the evidence produced, I have no hesitation in granting Letter of Administration as sought, this Original Petition stands allowed as follows:- (a) the letters of administration shall be issued in favour of the petitioner in respect of the properties mentioned in the petition.

(b) The petitioner is directed to duly administer the said properties of the deceased.

(c) The petitioner is also directed to execute a security bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) in favour of the Assistant Registrar (O.S-II), High Court, Madras. (d) The petitioner is further directed to render true and correct accounts once in a year.
