M/s.Selcia.R For Respondent : Mr.A.Gopinath Government Advocate (Crl.Side) COMMON ORDER The petitioners, who were arrested and remanded to judicial custody on 07.01.2026, for the offences punishable under Sections 69 of BNS, in Crime No.1 of 2026, registered on the file of the respondent police, seek bail. 2.The allegation against the petitioners is that the victim, aged about 25 years, was living alone. She was having several boyfriends and had sexual relationships with them, subsequently resulting in her pregnancy. This fact was intimated to her mother, who was living separately. Upon being taken to the hospital, the victim narrated the incident. Based on her statement, a case has been registered alleging that the petitioners made a promise to marry her, had

sexual relationship with her, and subsequently cheated her.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. He further submitted that the petitioners have been in judicial custody since 07.01.2026 and are willing to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation revealed that six persons induced the victim and had physical relationships with her, subsequently cheated her. He further submitted that some of the accused have already been arrested and the investigation is still ongoing.

5. Considering the nature of the allegations, the facts and circumstances of the case, and also the period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners 6.

Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each, for a like sum to the satisfaction

of the learned Judicial Magistrate Vandavasi, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioners shall appear before the respondent police daily at 10:30 a.m., for a period of three weeks and thereafter, as and when required for interrogation; [c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
