O R D E R
[Order of the Court was made by M.SATHYANARAYANAN, J] The present Contempt Petition has been filed alleging non compliance of the order passed in W.P.No.17023 of 2006 dated 30.08.2006.
2. The order, which is the subject matter of the contempt petition, came to be passed as early as on 30.08.2006 in W.P.No.17023 of 2006, with certain guidelines and alleging violation of the same, the petitioner has submitted a representation only on 12.08.2017, i.e. nearly after lapse of 11 years.
3. Learned counsel appearing for the petitioner would submit that since the guidelines/conditions imposed by this Court in the above cited order have not been complied with, being a continuous cause of action enabled the petitioner to invoke the contempt jurisdiction of this Court.
4. In the considered opinion of this Court, the said submission lacks merit for the reason that the present contempt petition is beyond the period of limitation and that apart as to the alleged violation of the order dated 30.08.2006 made in W.P.No.17023 of 2006, a representation came to be made only on 12.08.2017. Therefore, the petitioner is granted liberty to file a fresh writ petition, with regard to the alleged illegal sand quarry in Sankaraparani River, Tandavamurthykuppam Panchayat.
5. This Contempt Petition is dismissed with the above liberty.
