C.M.P.No.3404 of 2025 in C.M.A.SR.No.20263 of 2025 S.SOUNTHAR,J.

This petition has been filed to condone the delay of 941 days in filing the above Civil Miscellaneous Appeal.

2. Though notice served on the 1st respondent and his name is appeared in the causelist, there is no representation for the 1st respondent.

3. Heard the learned counsel appearing for the petitioner and M/s.R.Rathna Thara, learned counsel appearing for the 2nd respondent.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, delay is condoned. C.M.P.No.3404 of 2025 is allowed.

5. The Registry is directed to number the civil miscellaneous appeal and list the matter for admission, if it is otherwise in order.

6. It is made clear that the petitioner/claimant is not entitled to claim interest for the delay period of 941 days on the enhanced award amount in the event of her success in the appeal.

7. The Registry is further directed to print the name of M/s.R.Rathna Thara as counsel for the 2nd respondent in the cause-list at the time of admission.
