This petition has been filed to permit the petitioners to recall those depositors who were settled by the petitioners in order to record the settlement made to them in the pending proceedings in C.C.No.11 of 2015.

2.The learned Senior Counsel appearing on behalf of the petitioner submitted that out of the 56 persons to whom the settlement has to be made, 17 persons have agreed to settle the matter by receiving the amount from the petitioner. That apart, 10 other persons have already been settled and they must also be recalled to the Court to record their evidence. In so far as the balance depositors are concerned, the learned Senior Counsel submitted that steps are being taken to settle them also. 3.In the light of the above development, it is left open to the petitioners to file an application under Section 311 of Cr.P.C to recall the depositors who have been settled / who are willing to settle by receiving the deposit amount. krk application and shall recall those witnesses who have been settled or are willing to settle by receiving deposits made by them. 4.This Criminal Miscellaneous Petition is disposed of with the above directions.
