ORDER

This is the second anticipatory bail application filed by the petitioner. 2.

Though the earlier anticipatory bail petition of the petitioner Page No.1 of 4

was dismissed by my learned predecessor, Hon'ble Justice A.D.Jagadish Chandira, this petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl.O.P.No.31787 of 2024 on 04.03.2025.

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 8(c) and 20(b)(ii)(B) of the NDPS Act in Crime No.627 of 2024, seeks anticipatory bail.

The case of the prosecution is that A1 to A3 were found in illegal possession of 1300 grams of Ganja and were involved in selling the same; that based on the confession of the co-accused, the petitioner is sought to be implicated in this case.

The earlier anticipatory bail application was dismissed by this Court in Crl.O.P.No.578 of 2025, dated 20.01.2025, by making the following observations:

learned Government Advocate (Criminal Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that A1 to A3 found to be in illegal possession of 1300 grams of ganja and they were involved in selling the same. The petitioner herein is A4, based on the confession of the arrested accused, the petitioner herein has been roped in this case. He would further submit that there are 12 previous cases, out of which one is NDPS case.

5.Taking into consideration the above facts and circumstances of the case and the submission made by the learned Government Advocate, this Court is not inclined to grant anticipatory bail to the petitioner." 6.
