ORDER
The petitioner, who was arrested and remanded to judicial custody on 10.01.2026, for the alleged offence punishable under Sections 8(c) r/w. 20(b) (ii)(B) of the NDPS Act, 1985 in Crime No.5 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner was found to be in illegal possession of 1.280 kgs of ganja. Hence, the complaint.
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody since 10.01.2026. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case, and upon instructions, submitted that the petitioner is involved in the possession, transportation, and sale of ganja. He further submitted that there are 3 previous cases pending against the petitioner herein, out of which 1 is under NDPS Act. Hence, he opposed the grant of bail to the petitioner.
5. Considering the nature of the offence committed by the petitioner, and taking note of the fact that there are 3 previous cases pending against the petitioner, out of which 1 case is under NDPS Act, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
