ORDER
This Writ Petition is filed for issuance of a Writ of Mandamus to direct the respondent herein to grant continues provisional affiliation to the petitioner Institution for conducting M.Ed., Programme course for the academic session 2020-2021, 2021-2022, 2022-2023 to 2024-2025 and 2025-2026 to 2027-2028.

The learned counsel for the petitioner submitted that the petitioner institution applied and paid the necessary charges for grant of continuous affiliation in respect of M.Ed course for the academic year 2021-2022 and 20222023. Thereafter, the National Council for Teacher Education (NCTE) Southern Regional Committee by an order dated 24.11.2022, had withdrawn the recognition granted to the petitioner institution for the year 2023-2024. However, on the basis of the appeal filed by the petitioner, the NCTE by an order dated 08.12.2022, restored recognition granted to the petitioner institution. Thereafter, the NCTE by an order dated 14.08.2024 granted continuation of recognition to the petitioner institution for M.Ed., program. The petitioner 2/6
institution admitted students in M.Ed., program for the academic year 20242025, from the month of July 2024 and the classes also commenced as per the circular of the respondent.

The learned counsel for the petitioner would further submit that in pursuance to the order dated 14.08.2024, the petitioner institution had submitted its application on 19.10.2020, for the grant of continuation of provisional affiliation in respect of M.Ed degree programme from the year 2021 onwards. However, on receipt of such application, the respondent did not consider the same. According to the petitioner's counsel, the respondent did not open the portal for uploading the student details and for remitting the examination fees for the students admitted in the academic session for the year 2024-2025. Therefore left with no other effective remedy, the petitioner approached this Court for the aforesaid relief.
4. Heard both sides and perused the materials available on record.
5. It is seen that the petitioner's application for the grant of continuation of provisional affiliation in respect of M.Ed degree programme is 3/6
kept pending since 19.10.2020, without any action by the respondent. The respondents however approved the admission and allowed the students to write their examination for the previous academic years and also issued degree certificates. It is only for the academic year 2024-2025, the respondent has not opened the portal for uploading student details and for remitting fee for writing the examination. In view of the fact that the petitioner's applications right from the year 2020 are pending with the respondent and in the light of the grant of continuation of recognition to the petitioner institution for M.Ed., program by the NCTE vide its order dated 14.08.2024, this Court is inclined to issue a direction to the respondent to consider the petitioner's application dated 19.10.2020 within a time frame.
Hence in the light of the order passed by NCTE on 14.08.2024, the respondent is directed to consider all the petitioner's applications from 19.10.2020, and pass appropriate orders on merits and in accordance with law, within a period of two weeks from today. If for any reason, there is a delay on the part of the respondent in passing the order on the petitioner's application, the respondent shall open the portal for payment of fees for the academic year 2024-2025.
6. With the above observations and directions, this Writ Petition is allowed. No costs. Consequently, connected Miscellaneous Petition is closed. 4/6
