Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records of the first respondent in his proceedings in RA.5(i) 281/2009 A.A.5 of 2009 dated 10.05.2011 and quash the same and consequently direct the first respondent and fourth respondents to grant the petitioner's the DBBL gun licence as prayed for in the petitioner's application dated 05.05.2009.

ORDER

This writ petition has been filed challenging the order dated 10.05.2011 issued by the first respondent and for a consequential direction to the respondents to grant gun licence to the petitioner.

2. Heard the learned counsel on both sides.

3. The learned counsel for the petitioner submits that at the time of filing of the writ petition, the petitioner was working as a Security person with State Bank of India, Kallakurichi. He now submits that the petitioner is no more an employee of State Bank of India. The impugned order was passed based on the representation given by the petitioner that he was working as a Security person with State Bank of India, Kallakurichi Branch. Since, the petitioner is no more working with State Bank of India, nothing survives for adjudication in this writ petition. However, the learned counsel for the petitioner submits that as a security personnel, the petitioner is entitled for Gun licence under the Arms Act.

4. This Court is of the considered view that if the petitioner is still interested in obtaining a Gun Licence, he has to submit a fresh application with the fourth respondent and satisfy all the statutory requirements under the Arms Act.

5. For the foregoings reasons, this writ petition is closed as nothing survives for adjudication in this writ petition. No costs. However, liberty is granted to the petitioner to apply for a fresh Gun Licence and the fourth respondent shall consider the same as and when it is applied in accordance with law.
