IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 13.04.2017

CORAM:

THE HON'BLE MR. JUSTICE T.RAJA W.P.No.8811 of 2017 & WMP No. 9662 to 9664 of 2017 P.Sasikala ... Petitioner Vs 1.The Secretary to the Government, Department of School and Higher Education, Secretariat, Chennai - 9.

2.The Director, Department of School and Higher Education, College Road, Chennai - 6.

3.The Chief Educational Officer, Office of the Chief Educational Officer, Namakkal District.

... Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus to call for the records relating to the impugned second respondent's Notification dated 22.04.2015 to recruitment of Lab Assistant posts in 3rd respondent's office and quash the same and consequently direct the third respondent to give appointment of Lab Assistant to the petitioner under SCA (W) PSTM (Scheduled Caste) Arunthathiyar Women Quota.

For petitioner : Mr.P.Saravanan For Respondents : Mr.K.Venkataramani, AAG Assist. By Mr.P.Sanjaygandhi, AGP

O R D E R

By way of filing this writ petition, the petitioner seeks to quash the impugned Notification dated 22.04.2015 published by the second respondent / the Director, the Department of School and Higher Education, Chennai, for direct recruitment to the post of Lab Assistant, with a further

direction to appoint her to the said post under SCA (W) PSTM category.

2. The petitioner, having completed the Degree in B.Sc. (Chemistry) and B.Ed., applied for the post of Lab Assistant conducted by the Tamil Nadu School and Higher Education Department, through Advertisement dated 22.04.2015. She belongs to SC Arundhadhiyar (SCA) category and she has also studied in Tamil Medium and therefore, she would come under the category of SCA W PSTM. She has also appeared for the written examination and thereby she obtained 96 marks under SCA W PSTM quota.

3. At this juncture, the only grievance of the petitioner is that although the third respondent has published the selection list for certificate verification, her name was not found place as she has obtained 96 marks and on the other hand, candidates under SCA(G)(T) category, who have obtained 102, 101, 99, 99, 97, 97 marks, were called for certificate verification.

4. Therefore, when a specific question was posed to the learned Additional Advocate General for the respondents as to what is the cut-off marks fixed for SCA W PSTM category, on instruction, learned Additional Advocate General produced a copy of the proceedings dated 12.04.2017 of the third respondent, wherein it is seen that the third respondent has fixed the cutoff marks for SCA W PSTM category as 97 marks.

5. On this score, in my considered view, the petitioner, having obtained only 96 marks, is not eligible to be considered for the post of Lab Assistant, as the third respondent has fixed the cut-off marks for SCA W PSTM category as 97 marks. Thus, I do not find any substance in the prayer made by the petitioner and accordingly, the writ petition is dismissed. No Costs. Consequently, connected miscellaneous petitions are closed.
