ORDER

This Writ Petition has been filed for the issue of writ of Mandamus, directing the respondents to consider the objections made by the petitioner, who is seeking for cancellation of patta granted to the 3rd respondent. 2.

The case of the petitioner is that the petitioner is the owner of the property in question by virtue of a Partition Deed. According to the petitioner, the 3rd respondent has fabricated certain documents and he has obtained a patta in his https://hcservices.ecourts.gov.in/hcservices/

favour. Therefore, the petitioner has made a complaint to the respondent to cancel the patta given in favour of the 3rd respondent. The grievance of the petitioner is that the complaint is yet to be considered and therefore, left with no other option, the present writ petition has been filed before this Court.

Heard the learned counsel appearing for the petitioner.

The learned Government Advocate on instructions submitted that based on the complaint given by the petitioner, the 2nd respondent has initiated an enquiry and the date of enquiry is fixed as 10.03.2020. The learned counsel further submitted that notice has already been sent both to the petitioner as well as to the 3rd respondent.

Taking into consideration the facts and circumstances of the case and the limited relief that has been sought for in this writ petition, there shall be a direction to the 2nd respondent to consider the complaint given by the petitioner and pass appropriate orders, strictly in accordance with law, after giving an opportunity to the 3rd respondent, within a period of six weeks from the date of receipt of copy of this order. 6.

This writ petition is disposed of with the above directions. No costs.
