This petition has been filed seeking to direct the respondents to register the petitioner's complaint dated 30.05.2016 and investigate the same in accordance with law. 2.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. 3.

On a reading of the complaint dated 30.05.2016, it is seen that the petitioner sold his property to the opposite party in the year 2013 and thereafter, the parties have entered into an agreement under which the opposite party had agreed to re-convey the property, on the petitioner by paying a certain amount. According to the petitioner, he is ready and willing to make the payment, whereas, the opposite party is not ready and willing to re-convey the property.

In a case of this nature, wherein, the transaction involved is civil in nature, no positive direction can be issued to the respondent police to register an FIR.
