ORDER

This writ petition has been filed to direct the second respondent to modify and transfer the patta for the property, morefully disclosed in the affidavit filed

in support of this writ petition in favour of the petitioner, based on the petitioner's application dated 06.10.2025, within a time frame to be fixed by this Court.

2.According to the petitioner, for the property, morefully disclosed in the affidavit filed in support of this writ petition, erroneously patta has been issued in the name of the fourth respondent, who is dead. The petitioner seeks for modification of the same and thereafter, transfer the patta in his favour. The petitioner had submitted an application to the second respondent for the said purpose on 06.10.2025. Since the same has not been considered, this writ petition has been filed.

3.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 3. Since no adverse order is being passed against the fourth respondent or his legal representatives in this writ petition, notice to them is dispensed with by this Court.

4.No prejudice would be caused to the official respondents if the petitioner's application, as stated supra, is considered, on merits and in accordance with law, after hearing the objections of all the necessary parties, including the legal representatives of the deceased fourth respondent and any

other third party whom the second respondent deems it fit to enquire, within a time frame to be fixed by this Court.

5.This Court is not expressing any opinion on the merits of the petitioner's application.

6.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioner's application dated 06.10.2025 seeking for modification of the patta, now standing in the name of the fourth respondent, who according to the petitioner is dead and subsequently, transfer the patta in the name of the petitioner for the property, morefully described in the affidavit filed in support of this writ petition, after hearing the objections of the legal representatives of the fourth respondent and also any other third party whom the second respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
