ORDER

The case of the prosecution is that on 24.03.2022 at about 23.00 hours, while the respondent police were on their routing surveillance duty, intercepted a Bullock cart and found that the petitioner had illegally transported 1⁄4 unit of river sand without any valid approval or permit. Hence, the case.

2. This is the second anticipatory bail petition before this Court. The earlier anticipatory bail petition in Crl. O.P. No. 31459 of 2024 was dismissed on 17.12.2024 by Hon'ble Mr.Justice A.D.Jagadish Chandira and this anticipatory bail petition is listed before this Court pursuant to the orders passed by the Hon'ble Division Bench of this Court in Crl. O.P. No. 31787 of 2024 on 04.03.2025.

3. Learned Government Advocate (Crl. Side) submitted that, after the registration of the instant case, one more case registered against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

4. This Court while dismissing the first anticipatory bail petition passed the following order: - "6. Taking note of the facts and circumstances of the case and the petitioner herein has 6 previous cases, this Court is not inclined to grant anticipatory bail to the petitioner."

5. Considering the fact that the earlier anticipatory bail petition was dismissed since the petitioner has 6 previous cases, this Court is not inclined to entertain this second anticipatory bail petition.
